50+ WOMEN'S AND SOCIAL JUSTICE ORGANIZATIONS SIGN AMICUS BRIEF IN LAWSUIT TO RATIFY THE EQUAL RIGHTS AMENDMENT

On July 1, 2020, the Chicago law firm Winston & Strawn filed the Women's Movement amicus brief in support of the the lawsuit brought against the U.S. Archivist by the Attorneys General of Illinois, Nevada, and Virginia in support of the ratification of the Equal Rights Amendment. The brief asks the court to hold that the original time limit cannot stop the ERA's ratification now that it has met the requirements for amendment to the United States Constitution.

With the strong leadership of Linda Coberly, the firm's Managing Partner Chair of the Appellate and Critical Motions Practice, the amicus brief was filed on behalf of the ERA Coalition, of which Coberly also serves as Chair of the coalition’s Legal Task Force. Coberly's dedication resulted in the signing of the brief by 52 women's and social justice organizations. A full list of the organizations is below.

“Winston & Strawn is thrilled to be presenting a brief on behalf of such a diverse and powerful group of organizations that fight for equality every day,” said Coberly in a press release from the firm. “Winston has been a proud advocate of the ERA for several years, beginning with the successful effort for ratification in Illinois. We’ve since been honored to support the national movement, and we are committed to leveraging our resources through to final adoption.”

Filed in late January 2020, the AG's lawsuit is intended to legally compel U.S. Archivist David Ferriero to publish Virginia's ratification of the ERA earlier that month. That same month, just days after Virginia's historic vote to become the 38th, and final necessary state, to ratify the ERA. Just days later, the House of Representatives voted to pass H.J. RES 79 which officially removed the time limit stated in the ERA's preamble. The U.S. Senate has yet to hold hearings or hold a floor vote for SJ RES 6, which is seen by legal scholars as the final barrier to the ERA's addition to the U.S. Constitution.

We will continue to monitor developments of the lawsuit and report developments as they emerge.

Thank you for your work to ensure the health and safety of all Americans during this health crisis and your particular attention paid to the economy and workers in our country. As you return to attending to many issues of importance, along with continued efforts with the Coronavirus pandemic, we ask that you remember the equal rights of women in our country.

As a [member of INSERT ORG and/or resident and voter in INSERT STATE], I am writing to urge you to co-sponsor and support SJ Res 6, the bill to remove the deadline from the 1972 Equal Rights Amendment (ERA). The bipartisan bill was introduced by co-lead sponsors Senator Ben Cardin (MD) and Senator Lisa Murkowski (AK). The House companion bill, HJ Res 79, was passed with bipartisan support on February 13, 2020. It is now up to the Senate to be on the right side of history, as we celebrate the centennial of women’s suffrage.

Polling conducted by the ERA Coalition shows that equality is something we can all agree on. Their research found that 94% of respondents would support an amendment to the Constitution to guarantee equality for women and men, including 99% of millennials! Near-universal support crosses party lines, reaffirming the bipartisan history of the ERA.

Drafted by Alice Paul, the ERA was first introduced nearly 100 years ago in 1923. The ERA was passed through both houses of Congress in 1972, but fell just three states short of ratification when the time limit expired in 1982. However, with renewed momentum, Nevada became the 36th state to ratify in 2017 and Illinois quickly followed to become the 37th in 2018. In January 2020, Virginia became the 38th, reaching the threshold set by Article V of the Constitution, which provides that an amendment is effective when ratified by three-quarters of the states. It is past time for the U.S. Constitution to explicitly protect women from discrimination, and Congress has the opportunity to remove any ambiguity surrounding the ERA’s ratification.

ERA in the News: June 13-, 2020

HISTORIC SUPREME COURT DECISION ON SEX DISCRIMINATION

This past Monday, the U.S. Supreme Court made a historic ruling in their decision for Bostock v. Clayton County , citing that the Civil Rights Act of 1964 protects gay, lesbian, and transgender employees from discrimination based upon their sex. In the 6-3 ruling, for which Justice Neil Gorsuch wrote the 33-page majority opinion, the court declared employment discrimination based on sex illegal.

"It is impossible to discriminate against a person for being homosexual or transgender without discriminating ... based on sex," Gorsuch wrote.

This landmark ruling is a significant advancement in securing federally protected legal equality for GLBTQIA+ citizens. Gorsuch was joined by Chief Justice John Roberts in his opinion. You can read their opinions, and those of dissenting Justices Samuel Alito and Brett Kavanaugh, HERE.

ERA & WOMEN OF COLOR: VIRTUAL TOWN HALL

This past Thursday, the ERA Coalition hosted another phenomenal virtual town hall event. This week's event examined the impact of the Equal Rights Amendment on the lives of women and girls of color.

Moderator Carol Jenkins, co-President and CEO of the ERA Coalition/Fund for Women’s Equality, began the event with the image at left to highlight the leadership by women of color in the nearly 100-year fight for the Equal Rights Amendment.

The robust conversation spoke directly to the current social justice protests happening across the country due to police brutality, and offered insight and opportunity on how each of us whom believe in "Equality for All" can contribute to the movement to end systemic racism.

On Wednesday, members of the Delaware Legislative Black Caucus introduced the Justice for All Agenda and state Senate Bill 191 , which is designed to amend Article 1 of the Delaware constitution relating to equal rights. The legislation will add race, color and national origin to the protections of equal rights.

“With the passage of the Equal Rights Amendment ,the Justice for All Agenda would not only address discrimination but help us prioritize policies impacting communities of color,” said State Sen. Darius Brown, a Democrat representing Delaware’s 2nd District.

The move comes as the nation experiences a groundswell of activism in the fight for racial and social justice. If passed, SB 191 will ensure legal protections against discrimination based on sex, race, color, or national origin. Click HERE to watch the news segment.

This past week, Jessica Laus, a community organizer and member of the Advocacy Committee of the Alice Paul Institute, shared with the committee a 1976 recording of Say Brother, one of the longest-running public affairs talk-shows for and about African Americans. Produced by WGBH (Boston), in this episode, entitled " Black Women and the ERA," host Leah Fletcher focuses on the Equal Rights Amendment as it relates to minority women at both the state and federal level. A range of guests, including Flo Kennedy, founder of the National Feminist Party, speaks about racism present within the fight for the Equal Rights Amendment.

The 1-hour recording provides vital insight into how women of color viewed the ways in which the ERA would impact them in their fight against gender and race discrimination. It also speaks to the impressions held by women of color regarding the level of intersectionality extended to them by white upper-class women within the movement in the late 1970s. Definitely worth our time to watch, listen, and reflect.

Across the nation, we are bearing witness to an emotional rawness and swell of civic activism that reveals the intensity of the work we must continue to dedicate ourselves so that we can, unequivocally, ensure that all people are truly equal in our country.

The staff, board of directors, and members of the Alice Paul Institute's Advocacy Committee mourn the deaths of Americans during incidents with law enforcement. Through our grief, we remain ever focused on doing the work—every single day of every week—to create the positive social change mandatory for our democracy to work for all people, equally.

The ERA Coalition is continuing their vibrant series of a virtual town hall events to inform and raise awareness of the Equal Rights Amendment. On Thursday, June 4, 2020, Senator Lisa Murkowski (R-AK), delivered a compelling address about Equality on the Senate floor. Originally scheduled to speak in recognition of the anniversary of the day's events— in 1919 when the U.S. Congress passed the 19th Amendment and sent it to the states for approval—Murkowski's address reflected the heartbreaking events of recent days.

Speaking on the same day as the memorial service for George Floyd, the man killed at the hands of police in Minneapolis, and directly following a robust and passionate debate over a proposed amendment to an anti-lynching bill , Murkowski recognized the long path ahead of this nation to achieve equality for all. A co-lead sponsor of SJ Res 6 with Senator Ben Cardin (D-MD), the bill to remove the time limit on the Equal Rights Amendment, she spoke of the vital need to fully ratify the Equal Rights Amendment by passing the resolution to remove the time limit originally assigned to the ERA.

"The 100th anniversary of women's suffrage is a reminder of the progress that we've made as a nation, but we know that we have more to do, that inequities remain whether in the workforce, pay equality, and so continuing that work is a matter that we have not relaxed on," Sen. Murkowski said. "And that work, that work, Mr. President, includes getting the Equal Rights Amendment signed into law."

Senator Cardin, who was not able to speak on the floor with Murkowsi due to a scheduling conflict, released this statement in support of SJ Res 6: “We are proud to work together on a bipartisan basis to move this essential legislation over the finish line and finally make the ERA part of the Constitution — guaranteeing equality under the law for women. Women should not be held back or provided less opportunity, respect or protections under the law because of their gender. Gender equality should be an explicit, basic principle of our society. This is not a partisan issue but one of universal human rights.”

MRS. AMERICA FINAL EPISODE DROPS

The final episode of the Mrs. America mini-series dropped this past Wednesday. Co-produced by Cate Blanchett, who stars as anti-ERA activist Phyllis Shlafly, the series is a fictionalized portrayal of the fight to ratify the Equal Rights Amendment during the 1970s and 1980s.

This past week in an interview reported in The Guardian, feminist leader Gloria Steinem, who is played by the actress Rose Byrne in the series, called the show "ridiculous." She went on to say:

“For instance, there’s now a not very good series here called Mrs America and it gives you the impression that … Schlafly, who was a very religious and rightwing woman who opposed the equal rights amendment … it gives you the impression that she was the reason it was defeated.

In actuality, I don’t believe she changed one vote. Nobody could ever discover that she changed even one vote. The insurance industry here opposed the Equal Rights Amendment because if they stopped segregating their actuarial tables it would cost them millions upon millions of dollars .”

The Mrs. America mini-series has been fun and entertaining television to watch, yet we've come to realize that it does not adequately address the Equal Rights Amendment, its complex history, or what it will do for women and men in America once it is fully ratified to the U.S. Constitution. The script of the series is strong, the acting and costumes superb, and engaging storytelling through gorgeous cinematography, but the lack of clarity and focus on the powerful impact the ERA will have has been a disappointment.

In the coming weeks, the members of the ERA Advocacy Committee of the Alice Paul Institute will be designing, creating, and launching new content to address the void of information left by the Mrs. America series. We're putting together some dynamic Virtual "Meet-Ups" and have launched our ERA Storytellers Project to collect the stories of activists who were working to advance the ERA in the 1970s and 1980s (more info below). We are also designing more ready-to-post social media content to support your advocacy efforts. Keep an eye on this weekly newsletter and our social media streams for more announcements and releases. The second episode of Mrs. America explored the connection between the fight for the Equal Rights Amendment and the fight for reproductive rights. Today we are sharing our response to the frequently asked question: How has the ERA been related to reproductive rights?

The repeated claim of opponents that the ERA has the overt effect of requiring government to allow “abortion on demand” misrepresents existing federal and state laws and court decisions.

In federal courts, including the Supreme Court, a number of restrictive laws dealing with contraception and abortion have been invalidated since the mid–20th century based on the constitutional principles of right of privacy and due process, not equal rights. Roe v. Wade (1973) falls squarely in the middle of a line of court decisions expanding the interpretation of individuals’ constitutional "right to privacy" to protect against excessive governmental reach into certain personal decisions in their lives.

State equal rights amendments have been cited in several state court decisions (e.g., in Connecticut and New Mexico) dealing with a very specific issue – whether a state that provides funding to low-income Medicaid-eligible women for childbirth expenses should also be required to fund medically necessary abortions for women in that program. The courts ruled that the state must fund both of those pregnancy-related procedures if it funds either one, in order to prevent the government from using fiscal pressure to influence a woman’s exercise of her right to make medical decisions about her pregnancy. The New Jersey Supreme Court issued a similar decision based on the right of privacy and equal protection, not on the state constitution’s equal rights guarantee.

The presence or absence of a state ERA or equal protection guarantee does not necessarily correlate with a state’s legal climate for reproductive rights. Despite Pennsylvania’s state ERA, the state Supreme Court decided that restrictions on Medicaid funding of abortions were constitutional. The U.S. Supreme Court in separate litigation ( Planned Parenthood v. Casey , 1992) upheld Pennsylvania’s restrictions on abortion under the federal due process clause.

State court decisions on abortion are not conclusive evidence of how federal courts would decide such cases. While some state courts have required Medicaid funding of medically necessary abortions, the U.S. Supreme Court has upheld the constitutionality of the federal “Hyde Amendment,” which prohibits federal government funding of nearly all Medicaid abortions, even medically necessary ones.

Recent Supreme Court decisions on reproductive rights (e.g., Burwell v. Hobby Lobby Stores, Inc. , 2014) have raised concerns about the legal vulnerability of women’s right of privacy to have access to contraception as well as abortion."

A professor of sociology, political science, and liberal Studies at The Graduate Center of the City University of New York (CUNY), where she also serves as the academic dean overseeing the Graduate Center’s interdisciplinary master’s programs. Suk earned a J.D. from Yale Law School, where she studied on a Paul & Daisy Soros Fellowship for New Americans and a D.Phil. in Politics from Oxford University, where she held a Marshall Scholarship.

ERA in the News: April 11-17, 2020

So.....what to you think of Mrs. America , so far?

The first three episodes of FX's new series, Mrs. America dropped for streaming this past Wednesday, and we are receiving fabulous feedback and questions submitted through the website ( www.EqualRightsAmendment.org ) and via our social media streams. We have also seen a huge uptick in traffic to the website, and are welcoming 60+ new subscribers to this newsletter (Welcome!) who signed up in the past 3 days (WOW!).

You'll note that a huge increase in stories in this week's newsletter are directly related to this new show, starring Cate Blanchett as the anti-ERA activist Phyllis Shlafly. WILL YOU BE WATCHING MRS. AMERICA?

This coming week, the first show of FX's new series, Mrs. America , will premier on Wednesday, April 15, 2020. With an all-star cast, Mrs. America profiles the movement to ratify the ERA and the conservative backlash led largely by Phyllis Schlafly.

Here's a quick rundown of the cast:

Margo Martindale as Bella Abzug
Uzo Aduba as Shirley Chisholm
Elizabeth Banks as Jill Ruckelshaus
Tracey Ullman as Betty Friedan
Cate Blanchett as Phyllis Shlafly

A series of nine shows, Mrs. America will begin airing on April 15th. It is only available for streaming on Hulu. Hulu has a free 30-day trial period, if you want to watch the series.

While we're not especially cool with Phyllis Shlafly receiving any more attention, this review from Vanity Fair gives us a spark of hope that the ERA is the "shero" of the story.

ERA in the News: March 28 - April 3, 2020

Hello friend.

How are you doing? Are you okay?

The world is changing at a breakneck pace, and we are worried for women. Maybe you are too.

We are worried for the millions of women in the health care profession who are at risk while working to save lives in hospitals and clinics around the world.

We are worried for the financial stability of women and girls as the global economy falters , and how the future of countless women and girls will be significantly effected as they always are in times of economic upheaval.

We are worried for the women who are teachers , as schools across the nation are closed (or closing), some for the remainder of the school year, and educators are asked to perform miracles and conduct class via video conference. We are worried for the mothers who suddenly are homeschooling their children , trying to keep their children's education on a path to success.

We are worried for the women in the service and retail industries who cannot work from home, but report to work and place themselves at risk to ensure people have the supplies they need.

We are worried about the women and girls that are at greater risk for domestic violence in their homes during the shelter-in-place orders.

As women around the world work hard for their families and communities, inside and outside of the home, we continue to send our best to each of you as we adapt to a new "normal." We are cheering you on. We are sending our support. We remain committed to our advocacy for women and girls.

Be well, friend. We care about you.

GENERATION RATIFY

Have you heard of Generation Ratify? This dynamic group is mobilizing youth across the nation to advocate for the Equal Rights Amendment.

In response to the COVID-19 public health crisis, Generation Ratify is hosting the Digital ERA Action Bootcamp, an 8-week program that will guide youth activists through mentorship, webinars, and actions to grow as organizers as they learn how to effectively digitally organize, build community online, and advocate for the ERA. During the 8 week program, participants will be taken through a total of eight 1-hour virtual training sessions that will educate about the ERA and teach participants on how to advocate for it, even during the Coronavirus pandemic.

Members of Congress and their staffs are working remotely in response to the COVID-19 public health crisis. This has effected the ability of both houses to hold their in-person voting processes. In the past, Congress has been slow to adopt a remote voting process.

Greetings to each of you today. As we face this global health crisis, we offer our sincere hope that you, your families, friends, and coworkers are all staying safe during these challenging times.

We know that women across the nation are now shouldering even larger burdens in support of their families and communities. Please know that we see you, and are sending our encouragement. Together, we will find new ways to collaborate and help each other through whatever the coming weeks may bring.

ERA CAMPUS DAY - APRIL 27, 2020

University students from Hunter College (NY) are working to coordinate the 4th Annual ERA Campus Day on April 27, 2020. This event has been largely a virtual experience in years past, and will be fully virtual this year as college campuses across the nation have moved to remote learning systems in response to the COVID-19 public health crisis.

The organizers are actively recruiting college campuses across the nation to participate. Can you help them? Their goal is to have at least one university in each state participate. Below is the letter in circulation. Please share with anyone in your network that may be interested in supporting their efforts.

To whom it may concern,

We would like to invite you to the Fourth Annual Campus Equal Rights Amendment Day taking place on April 27, 2020 from 6:00-7:30 pm EST at Roosevelt House, Hunter College. We know that many campuses are shifting to distance learning and we hope you will be able to join us virtually via Zoom. We plan to create a program that accommodates students all across the country. The event is being organized by a cohort of students participating in the Grove Fellowship at Hunter College , led by Carol Jenkins and Bettina Hager, of the ERA Coalition. If you wish to participate, please fill out the Interest form here .

There is a revitalized push to ratify the Equal Rights Amendment, which would enshrine sex equality into the United States Constitution. The ERA would provide the effective legal recourse necessary for women and girls to fight economic inequality, workplace discrimination, violence against women, and other forms of discrimination. We aim to highlight the work being done and gain support from students all across the country.

The event will feature a screening of a short background video followed by an exciting panel of notable experts on the issue of gender equality and live Q&A with other campuses across the country. Attendees will learn more about the status of the amendment and what we are doing to ensure its passage.

Last year, Campus ERA Day included a live-streamed panel discussion with Academy Award-winning actor and activist Patricia Arquette, House Judiciary Chairman Jerrold Nadler, Congresswoman Carolyn Maloney (D-NY), Nevada State Senator Dr. Patricia Spearman, and Virginia House Delegate Jennifer Carroll Foy.

This year, we hope to have colleges join us from all 50 states, with a special focus on the unratified states. We will also be incorporating an action to pressure the Senate to pass SJ Res 6, the bill to remove the deadline from the 1972 ERA. The U.S. House passed the companion bill, HJ Res 79, in February.

UPDATES ON S.J. RES 6 IN THE SENATE

We are continuing our work to gain co-sponsors on the Senate bill to remove the original time limit on the Equal Rights Amendment. Things will likely slow down as members of Congress respond to the COVID-19 public health crisis, but we will keep you all updated on any new co-sponsors that sign on.

Every single Democrat in the U.S. Senate have now officially signed on. We are moving our focus to encouragement to the Republican and Independents to sign on in support.

INCREASING ADVOCACY IN THE U.S. SENATE

We are not losing any momentum following the recent victories with the Equal Rights Amendment. Join us as we turn our energy to the U.S. Senate.

In last week's newsletter, we shared that five new senators had signed on as co-sponsors for SJ Res 6, the resolution to remove the time limit from the ERA. It is important to note that all five of these senators - Coons (D-DE), Carper (D-DE), Heinrich (D-NM), Cantwell (D-WA), and Tester (D-MT) - were on the "Call To Action" list that we have had in circulation for several weeks now. This is a huge success, and one that we want to keep replicating. We encourage each of you to keep contacting the senators listed below, in addition to the Senators who represent your state, and urge them to sign on to SJ RES 6. Help us gain momentum in the Senate!

HOUSE VOTES TO PASS H.J. RES 79

On Thursday, February 13, 2020, the U.S. House of Representatives passed House Joint Resolution 79, the bill to remove the deadline from the Equal Rights Amendment. The bipartisan vote of 232-183, including 5 "yea" votes from Republican members, marked a momentous act in the journey of the Equal Rights Amendment toward ratification.

We extend our deepest gratitude to the leaders in the House, HJ Res 79 Sponsor Representative Jackie Speier, longtime ERA champion Representative Carolyn Maloney and the Leadership for bringing the bill to the floor- Speaker Nancy Pelosi, Majority Leader Steny Hoyer and Chairman Jerry Nadler.

We also send our appreciation to the staff, board, and volunteers of the ERA Coalition. Without their years of leadership, dedication, and tireless work educating elected officials and their staff members on the ERA, this week's vote on HJ Res may not have occurred.

We now move on to the Senate , with exciting news that Delaware Senators Coons and Carper co-sponsored SJ Res 6 just signed on as co-sponsors. The only Democrats not signed onto the legislation are now Sen. Leahy (VT) and Sen. Manchin (WV).

Postcard Party Sends 550 Postcards to Congress

Our "I Love the ERA" postcard writing party was so much fun. Over 30 women and men joined us this past Tuesday night at the Alice Paul Institute to write postcards to Congress members.

Over 550 postcards were written, stamped, and addressed. Postcards were sent to say "Thank You!" to leaders who have long fought for the ERA, as well as postcards to strongly encourage Senators to sign onto SJ Res 6 as co-sponsors.

As Alice Paul organized Valentine's Day card campaigns to elected officials in support of the 19th Amendment, our ERA postcards should be arriving in the mail today - Valentine's Day - to show our love for equal rights.
