The second episode of Mrs. America explored the connection between the fight for the Equal Rights Amendment and the fight for reproductive rights. Today we are sharing our response to the frequently asked question: How has the ERA been related to reproductive rights?

The repeated claim of opponents that the ERA has the overt effect of requiring government to allow “abortion on demand” misrepresents existing federal and state laws and court decisions.

In federal courts, including the Supreme Court, a number of restrictive laws dealing with contraception and abortion have been invalidated since the mid–20th century based on the constitutional principles of right of privacy and due process, not equal rights. Roe v. Wade (1973) falls squarely in the middle of a line of court decisions expanding the interpretation of individuals’ constitutional "right to privacy" to protect against excessive governmental reach into certain personal decisions in their lives.

State equal rights amendments have been cited in several state court decisions (e.g., in Connecticut and New Mexico) dealing with a very specific issue – whether a state that provides funding to low-income Medicaid-eligible women for childbirth expenses should also be required to fund medically necessary abortions for women in that program. The courts ruled that the state must fund both of those pregnancy-related procedures if it funds either one, in order to prevent the government from using fiscal pressure to influence a woman’s exercise of her right to make medical decisions about her pregnancy. The New Jersey Supreme Court issued a similar decision based on the right of privacy and equal protection, not on the state constitution’s equal rights guarantee.

The presence or absence of a state ERA or equal protection guarantee does not necessarily correlate with a state’s legal climate for reproductive rights. Despite Pennsylvania’s state ERA, the state Supreme Court decided that restrictions on Medicaid funding of abortions were constitutional. The U.S. Supreme Court in separate litigation ( Planned Parenthood v. Casey , 1992) upheld Pennsylvania’s restrictions on abortion under the federal due process clause.

State court decisions on abortion are not conclusive evidence of how federal courts would decide such cases. While some state courts have required Medicaid funding of medically necessary abortions, the U.S. Supreme Court has upheld the constitutionality of the federal “Hyde Amendment,” which prohibits federal government funding of nearly all Medicaid abortions, even medically necessary ones.

Recent Supreme Court decisions on reproductive rights (e.g., Burwell v. Hobby Lobby Stores, Inc. , 2014) have raised concerns about the legal vulnerability of women’s right of privacy to have access to contraception as well as abortion."

About the Author: Julie Suk is a frequent commentator in the media on legal issues affecting women with recent interviews with The New York Times, The Washington Post, Vox, CBS News, and many others. The U.S. House Judiciary Committee cited Suk’s scholarly work on the ERA in its report supporting the removal of the ERA ratification deadline. A professor of sociology, political science, and liberal Studies at The Graduate Center of the City University of New York (CUNY), where she also serves as the academic dean overseeing the Graduate Center’s interdisciplinary master’s programs. Suk earned a J.D. from Yale Law School, where she studied on a Paul & Daisy Soros Fellowship for New Americans and a D.Phil. in Politics from Oxford University, where she held a Marshall Scholarship.

The first three episodes of FX's new series, Mrs. America dropped for streaming this past Wednesday, and we are receiving fabulous feedback and questions submitted through the website ( www.EqualRightsAmendment.org ) and via our social media streams. We have also seen a huge uptick in traffic to the website, and are welcoming 60+ new subscribers to this newsletter (Welcome!) who signed up in the past 3 days (WOW!).

You'll note that a huge increase in stories in this week's newsletter are directly related to this new show, starring Cate Blanchett as the anti-ERA activist Phyllis Shlafly. WILL YOU BE WATCHING MRS. AMERICA?

This coming week, the first show of FX's new series, Mrs. America , will premier on Wednesday, April 15, 2020. With an all-star cast,  Mrs. America  profiles the movement to ratify the ERA and the conservative backlash led largely by Phyllis Schlafly.

Here's a quick rundown of the cast:

  • Rose Byrne as Gloria Steinem

  • Margo Martindale as Bella Abzug

  • Uzo Aduba as Shirley Chisholm

  • Elizabeth Banks as Jill Ruckelshaus

  • Tracey Ullman as Betty Friedan

  • Cate Blanchett as Phyllis Shlafly

A series of nine shows, Mrs. America will begin airing on April 15th. It is only available for streaming on Hulu. Hulu has a free 30-day trial period, if you want to watch the series.

While we're not especially cool with Phyllis Shlafly receiving any more attention, this review from Vanity Fair gives us a spark of hope that the ERA is the "shero" of the story.

Hello friend.

How are you doing? Are you okay?

The world is changing at a breakneck pace, and we are worried for women. Maybe you are too.

We are worried for the millions of women in the health care profession who are at risk while working to save lives in hospitals and clinics around the world.

We are worried for the financial stability of women and girls as the global economy falters , and how the future of countless women and girls will be significantly effected as they always are in times of economic upheaval.

We are worried for the women who are teachers , as schools across the nation are closed (or closing), some for the remainder of the school year, and educators are asked to perform miracles and conduct class via video conference. We are worried for the mothers who suddenly are homeschooling their children , trying to keep their children's education on a path to success.

We are worried for the women in the service and retail industries who cannot work from home, but report to work and place themselves at risk to ensure people have the supplies they need.

We are worried about the women and girls that are at greater risk for domestic violence in their homes during the shelter-in-place orders.

As women around the world work hard for their families and communities, inside and outside of the home, we continue to send our best to each of you as we adapt to a new "normal." We are cheering you on. We are sending our support. We remain committed to our advocacy for women and girls.

GENERATION RATIFY

Have you heard of Generation Ratify? This dynamic group is mobilizing youth across the nation to advocate for the Equal Rights Amendment.

In response to the COVID-19 public health crisis, Generation Ratify is hosting the Digital ERA Action Bootcamp, an 8-week program that will guide youth activists through mentorship, webinars, and actions to grow as organizers as they learn how to effectively digitally organize, build community online, and advocate for the ERA. During the 8 week program, participants will be taken through a total of eight 1-hour virtual training sessions that will educate about the ERA and teach participants on how to advocate for it, even during the Coronavirus pandemic.

Members of Congress and their staffs are working remotely in response to the COVID-19 public health crisis. This has effected the ability of both houses to hold their in-person voting processes. In the past, Congress has been slow to adopt a remote voting process.

Greetings to each of you today. As we face this global health crisis, we offer our sincere hope that you, your families, friends, and coworkers are all staying safe during these challenging times.

We know that women across the nation are now shouldering even larger burdens in support of their families and communities. Please know that we see you, and are sending our encouragement. Together, we will find new ways to collaborate and help each other through whatever the coming weeks may bring.

ERA CAMPUS DAY - APRIL 27, 2020

University students from Hunter College (NY) are working to coordinate the 4th Annual ERA Campus Day on April 27, 2020. This event has been largely a virtual experience in years past, and will be fully virtual this year as college campuses across the nation have moved to remote learning systems in response to the COVID-19 public health crisis.

The organizers are actively recruiting college campuses across the nation to participate. Can you help them? Their goal is to have at least one university in each state participate. Below is the letter in circulation. Please share with anyone in your network that may be interested in supporting their efforts.

To whom it may concern,

We would like to invite you to the Fourth Annual Campus Equal Rights Amendment Day taking place on April 27, 2020 from 6:00-7:30 pm EST at Roosevelt House, Hunter College. We know that many campuses are shifting to distance learning and we hope you will be able to join us virtually via Zoom. We plan to create a program that accommodates students all across the country. The event is being organized by a cohort of students participating in the Grove Fellowship at Hunter College , led by Carol Jenkins and Bettina Hager, of the ERA Coalition. If you wish to participate, please fill out the Interest form here .

There is a revitalized push to ratify the Equal Rights Amendment, which would enshrine sex equality into the United States Constitution. The ERA would provide the effective legal recourse necessary for women and girls to fight economic inequality, workplace discrimination, violence against women, and other forms of discrimination. We aim to highlight the work being done and gain support from students all across the country.

The event will feature a screening of a short background video followed by an exciting panel of notable experts on the issue of gender equality and live Q&A with other campuses across the country. Attendees will learn more about the status of the amendment and what we are doing to ensure its passage.

Last year, Campus ERA Day included a live-streamed panel discussion with Academy Award-winning actor and activist Patricia Arquette, House Judiciary Chairman Jerrold Nadler, Congresswoman Carolyn Maloney (D-NY), Nevada State Senator Dr. Patricia Spearman, and Virginia House Delegate Jennifer Carroll Foy.

This year, we hope to have colleges join us from all 50 states, with a special focus on the unratified states. We will also be incorporating an action to pressure the Senate to pass SJ Res 6, the bill to remove the deadline from the 1972 ERA. The U.S. House passed the companion bill, HJ Res 79, in February.

INCREASING ADVOCACY IN THE U.S. SENATE

We are not losing any momentum following the recent victories with the Equal Rights Amendment. Join us as we turn our energy to the U.S. Senate.

In last week's newsletter, we shared that five new senators had signed on as co-sponsors for SJ Res 6, the resolution to remove the time limit from the ERA. HOUSE VOTES TO PASS H.J. RES 79

On Thursday, February 13, 2020, the U.S. House of Representatives passed House Joint Resolution 79, the bill to remove the deadline from the Equal Rights Amendment. The bipartisan vote of 232-183, including 5 "yea" votes from Republican members, marked a momentous act in the journey of the Equal Rights Amendment toward ratification.

We extend our deepest gratitude to the leaders in the House, HJ Res 79 Sponsor Representative Jackie Speier, longtime ERA champion Representative Carolyn Maloney and the Leadership for bringing the bill to the floor- Speaker Nancy Pelosi, Majority Leader Steny Hoyer and Chairman Jerry Nadler.

We also send our appreciation to the staff, board, and volunteers of the ERA Coalition. Without their years of leadership, dedication, and tireless work educating elected officials and their staff members on the ERA, this week's vote on HJ Res may not have occurred.

Postcard Party Sends 550 Postcards to Congress

Our "I Love the ERA" postcard writing party was so much fun. Over 30 women and men joined us this past Tuesday night at the Alice Paul Institute to write postcards to Congress members.

Over 550 postcards were written, stamped, and addressed. Postcards were sent to say "Thank You!" to leaders who have long fought for the ERA, as well as postcards to strongly encourage Senators to sign onto SJ Res 6 as co-sponsors.

As Alice Paul organized Valentine's Day card campaigns to elected officials in support of the 19th Amendment, our ERA postcards should be arriving in the mail today - Valentine's Day - to show our love for equal rights.

THREE STATE ATTORNEYS GENERAL FILE LAWSUIT

On Thursday, January 30th, the ERA Coalition's Co-President and CEO Carol Jenkins joined Virginia Attorney General Mark R. Herring in Washington, D.C., at a press conference to announce landmark civil rights litigation in support of the Equal Rights Amendment.

The lawsuit, filed jointly by Herring, Illinois Attorney General Kwame Raoul, and Nevada Attorney General Aaron Ford, names David S. Ferriero, in his official capacity as Archivist of the United States as the defendant. The lawsuit seeks to force Ferriero to recognize Virginia's vote this week to ratify the Equal Rights Amendment and certify the measure as part of the Constitution. As the 38th, and final, state necessary for Equal Rights Amendment to ratify to the U.S. Constitution.

It is deeply significant that the Attorneys General of these three states have joined in this lawsuit. Each of these three states ratified the Equal Rights Amendment in recent years, helping to revive this vital legislation and bring renewed focus to the fight to legal and lasting gender equality in the United States. In 2017, Nevada became the 36th state to ratify, and the first to do so since the original deadline expired on June 30, 1982. Nevada was soon followed by Illinois (37th) in 2018, and this week Virginia made history by becoming the 38th state to officially ratify the ERA.

In a joint statement released on January 28, 2020, Senator Ben Cardin (D-MD) and Senator Lisa Murkowski (R-AK) released the following statement in response to Virginia’s ratification of the Equal Rights Amendment on January 27, 2020.

“With Virginia’s historic ratification of the Equal Rights Amendment, the state officially becomes the 38th and final state required to make the ERA part of the U.S. Constitution. This decades-long effort is now one step closer to victory and proving that there is no time limit on equality.

“We urge the Archivist to complete the ERA’s certification. Virginia has now passed the baton, so now Congress must do its part to get it over the finish line. We are pleased that in February the House of Representatives will take up legislation to remove any legal ambiguities with the arbitrary ratification deadline set decades ago. Soon thereafter we hope the Senate will take up our bipartisan legislation, S.J. Res. 6, to do the same and enshrine the prohibition of discrimination on the basis of sex into our Constitution once and for all.”

FLOOR VOTE COMING FOR H.J. RES 79

With the amazing energy following Virginia's official ratification of the Equal Rights Amendment, we are turning our full attention to the efforts in Congress to remove the original deadline assigned to the ERA.

Last week, Majority Leader Steny Hoyer announced that the U.S. House of Representatives plans to bring HJ Res 79, the bill to remove the deadline from the ERA, for a vote during the week of February 10th.

The fact that this vote is happening is a testament to the decades of hard work done by the fearless ERA leaders in the legislature - Rep. Jackie Speier (D-CA), the lead sponsor of the bill, and Rep. Carolyn Maloney (D-NY), a longtime ERA champion, the members of their staff and the countless citizens who have show their support for this legislation.

THE EQUAL RIGHTS AMENDMENT FULLY RATIFIED IN VIRGINIA

Today we change Virginia green, following the state’s historic vote to ratify the ERA.

Today we change Virginia green, following the state’s historic vote to ratify the ERA.

It is official!

The state of Virginia becomes the 38th state to ratify the Equal Rights Amendment.

Moments ago the Virginia General Assembly completed the procedural process for the ratification of the ERA by that state. With these actions the Equal Rights Amendment has officially reached the minimum of 38 states required by Congress for ratification to the U.S. Constitution when the amendment was passed in 1972.

Six Republican Senators joined with Democrat Senators to approve the Virginia House of Delegates' version of the ERA by a bi-partisan vote of 27-12. Thank you to both parties for working together. And in the House of Delegates, with a vote of 58-40 the House approved the Senate's version of the ERA.

The ERA is now ratified in Virginia!

We send our heartfelt gratitude to the millions of supporters who have fought for the ERA since it was first introduced by Alice Paul in 1923. She would be so very proud!

This is a day for celebration. If you are in Virginia, there is a party this evening to mark this amazing day. More information and tickets can be found HERE.

Fun fact: Female legislators elected to the state legislature in Virginia oversaw the final voting procedures in both the Virginia House and the Virginia Senate on this historic day. Virginia House Speaker Eileen Filler-Corn and state Senate President Pro Tempore Louise Lucas led today's voting.

Polling conducted by the ERA Coalition shows that equality is something we can all agree on. Their research found that 94% of respondents would support an amendment to the Constitution to guarantee equality for women and men, including 99% of women of color and millennials! This near universal support crosses party lines, reaffirming the bipartisan history of the ERA.

AWAITING VIRGINIA'S OFFICIAL RATIFICATION OF THE EQUAL RIGHTS AMENDMENT

We continue to monitor the procedural process in the Virginia General Assembly for the ratification of the ERA by Virginia to become completely official. Each chamber must vote to approve the other's chamber's resolution. Because the resolutions passed in both chambers are identical, it is not anticipated that the Equal Rights Amendment will encounter any issues.

We will send out a "Special Edition" newsletter as soon as we know the ERA is 100% official in Virginia!

We are turning our attention to the efforts in Congress to remove the original deadline assigned to the Equal Rights Amendment. VIRGINIA VOTES TO RATIFY THE EQUAL RIGHTS AMENDMENT!

The state of Virginia made history on Wednesday, January 15, 2020 by becoming the 38th state to ratify the Equal Rights Amendment. Sessions in both the Virginia State Senate and the House of Delegates voted to affirm the ERA's ratification to the United States Constitution..

We are celebrating this landmark victory, hard won by the advocates in Virginia and across the nation that worked tirelessly to promote and elect pro-ERA candidates to the Virginia state legislature, a tactic that we hope inspires ERA advocates across the country to support and elect candidates up and down the ballot that will fight for gender equality.

There is a final procedural process before the ratification of the ERA by Virginia becomes completely official. Each house must vote to approve the other's chamber's resolution. Because the resolutions passed in both chambers are identical, it is not anticipated that the Equal Rights Amendment will encounter any issues. Keep an eye out for a "Special Edition" newsletter that we'll send out when the ERA is 100% official in Virginia!

Many supporters are asking, "Now what?" and "What is next?"

Directly ahead is for us to redirect the amazing energy that has been building across the nation and put strong pressure on members to approve the  legislation in Congress to remove the original deadline assigned to the ERA. Citizens are asked to contact their congress people to urge them to sign on as a co-sponsor of H.J. Res 79 in the House of Representatives, and S.J. Res 6 in the Senate.

The update on co-sponsors of the bills is as follows:

  • H.J. Res 79 (House of Representatives) = 224 co-sponsors

  • S.J. Res 6 (Senate) = 41 co-sponsors (up from 33 two weeks ago!!)

Greetings ERA allies!

As you have likely heard by now, this week the Department of Justice's Office of Legal Counsel responded to the National Archives request for guidance by the on the subject of the ratification of the Equal Rights Amendment. In the statement, the OCL opines that the ERA is not valid for ratification because the deadline assigned to the amendment passed in 1982.

The Alice Paul Institute's response statement is as follows: 

"The memo released by the Department of Justice's Office of Legal Counsel is addressed to the Archivist of the National Archives. It does not bind Congress or the courts to the opinions stated within the memo.  

Congress may continue to move resolutions forward related to the Equal Rights Amendment's ratification to the U.S. Constitution. Article V of the Constitution states that Congress may propose amendments to the Constitution, which shall then be ratified by the states. There is no constitutional role for the Executive Branch or the National Archivist in making the amendment legally effective. The archivist’s role in the amendment process is purely ministerial."

Adding to a week of huge developments for the ERA is another legal challenge filed this week in the U.S. District Court for the District of Massachusetts by Equal Means Equal, The Yellow Roses, and Katherine Weitbrecht. The lawsuit names the U.S. Archivist David Ferriero as the defendant and aims to challenge the validity of the original deadline assigned to the ERA.

We invite you to watch a video of the members of the Virginia Senate opening the discussion on the ERA on January 9, 2020. In the video Michelle Kallen, Deputy Solicitor General of the Commonwealth of Virginia, addresses the DOJ's memo and notes that Article V of the Constitution, which defines the amendment process, assigns specific roles to Congress and the states but does not assign a role to the Executive Branch. She also observes that this memo expressly contradicts the Office of Legal Counsel’s prior position.

Happy New Year to each of you! We hope that everyone had a warm and fulfilling holiday season.

We are very excited for 2020! It is going to be an active year, full of celebrations of 100 years of women's voting rights since the 19th Amendment was ratified on August 26, 1920.

We are now officially only days away from the reconvening of the General Assembly in Virginia on January 8, 2020. We continue to monitor the situation to see when state legislators in that state will bring the Equal Rights Amendment up for a vote. It currently anticipated that the ERA will be brought for a vote on the senate floor within the first two weeks of the session, possibly as early as January 14, 2020. As of today, it is unknown when the House will bring the ERA up for a vote. We'll keep you updated!

You can also keep tabs on what VARatify is doing on their website, which you can visit HERE.

For those of you following the legislation in Congress to remove the original deadline assigned to the ERA, here is a quick update. In the House of Representatives, a total of 224 co-sponsors have signed on to H.J. Res 79. The sister bill in the Senate, S.J. Res 6, added another 14 members signed on as co-sponsors to bring the total up to 33. See below in the "Call to Action" section for more information on how you can help.

VALENTINE'S DAY CAMPAIGN!

We are taking a page from Alice Paul’s playbook and sending “I (Heart) the ERA” Valentine’s postcards to elected officials. 

Send a "Thank You!" to congresspeople who have signed on in support, or send a "ERA Valentine" to encourage representatives who have not yet signed on in support.

In their fight for women's suffrage, Alice Paul and the National Woman's Party sent "Valentine's" to the men elected to Congress. The tactic helped keep the issue at the forefront of conversation, and was one of many that Alice Paul employed to advance the 19th Amendment. Join us for a night of fun social activism in the fight for gender equality.

We're inviting ERA advocates across the country to join the campaign! Here are a few ways that you can join the fun:

1) Host a “I (Heart) the ERA” Valentine’s postcard writing party!

Order some pre-printed postcards from the ERA Toolkit, and invite your friends and send a Valentine to the list of officials we've selected and/or your local and state officials.

2) Download the "I (Heart) the ERA" social media squares and banner and share, share, share!

3) Download the postcard designs (front and back) and print your own to send to your elected officials.

The  ERA Coalition  is asking for our support to increase pressure on U.S. Senators to advance  SJ Res 6  , the legislation that will remove the original deadline from the ERA. Introduced by Sen. Ben Cardin (MD), more co-sponsors are needed to advance the bill.

Hello all.

We are now officially three weeks away from the reconvening of the General Assembly in Virginia on January 8, 2020. We are monitoring the situation to see when state legislators in that state will bring the Equal Rights Amendment up for a vote. We'll share information as soon as we have it.

As you may have heard, this past week the Attorney General in Alabama his filed a lawsuit to block the ERA's ratification. The state of Alabama is joined in the lawsuit by the states of Louisiana and South Dakota. It is a shameful exercise to continue to deny women and men constitutional equality. You can read more about the lawsuit HERE. We will be working to coordinate our response plan, and will keep you informed as this situation develops.

Krista Niles, the Outreach and Civic Engagement Director of the Alice Paul Institute has released this comment on the lawsuit: “ The Alabama Attorney General’s lawsuit to halt the progress of the Equal Rights Amendment toward full ratification to the Unites States Constitution is a deeply disappointing attempt to continue to deny women and men from gaining full constitutional equality. It replicates decades old misinformation campaigns that further deny citizens access to the truth, including the fact that 94% of Americans publicly support the Equal Rights Amendment. As 2020 approaches and we celebrate 100 years of women’s voting rights in the United States, the anti-ERA lawsuit is a shameful exercise that denies women, and men, equal legal rights .”

The ERA Coalition has released a statement on the lawsuit, in which they say, " The filing of a lawsuit by Alabama’s Attorney-General to stop the Equal Rights Amendment is a shameful effort to keep women from gaining Constitutional equality. 94% of Americans support the ERA - 99% of millennials who all believe that it is time to end second class citizenship for women who were intentionally left out of the Constitution more than two hundred years ago." Also, we would like to bring your attention to a statement released by the National Archives on December 19, 2020, in which an they announce an inquiry with the DOJ's Office of Legal Counsel. This inquiry is in response to the lawsuit. "In light of the public interest and ongoing debate about the Equal Rights Amendment (ERA), the National Archives and Records Administration (NARA) requested guidance from the Department of Justice’s Office of Legal Counsel on legal issues regarding ratification of the ERA. These issues are currently presented in a lawsuit filed by the states of Alabama, Louisiana, and South Dakota against the Archivist of the United States. NARA does not intend to take any action regarding the ERA until, at a minimum, it receives the guidance it previously requested and in no event before February 15, 2020."

Hello all!

The Equal Rights Amendment continues to gain momentum across the nation. Virginia remains the focal point of national attention as their state's General Assembly prepares to start their new session on January 8, 2020, with an expected vote on the ERA soon, but the past few weeks we have seen a significant increase in visibility of the ERA in Utah, South Carolina, and Florida.

A prominent anti-ERA campaign is surfacing in Utah, so if you live in that state please consider writing a letter to the editor or your local paper to show your support for the ERA. Also, contact your representatives in the state legislature to ensure they know why you need the ERA to be ratified.

Hello all!

 We hope that each of you have a warm and relaxing Thanksgiving holiday. We are covering two weeks of news stories in this week's newsletter, so there is a lot to report. The ERA has been hot in the media in Utah and Virginia! Check out those states below, and the opposition that is springing up in Utah.

 As we prepare for Virginia's General Assembly to ratify the ERA, possibly as soon as January 2020, lots of people are asking, "What happens next?"
